Phillip (Phil) Hosp is a partner in 麻豆直播 & Lardner LLP’s Commercial Litigation Practice and a trial lawyer whose work centers on financial services and private credit litigation. He represents private credit funds, direct lenders, banks, private equity funds and sponsors, real estate investment trusts, and fintech companies in their toughest disputes, delivering business-driven strategies that win in court, in arbitration, and at the settlement table. His practice spans private credit and direct lending disputes, loan enforcement and workouts, complex commercial litigation, securities litigation, financial services investigations, receiverships, and bankruptcy proceedings.

Phil helps private credit funds and their lenders enforce loans, protect collateral, and recover on defaulted and distressed credit. He handles borrower defaults, fraud and fraudulent transfer claims, collateral and priority disputes, and receivership and bankruptcy-related litigation arising from distressed credit investments.

Phil is also a member of the firm’s Blockchain & Digital Assets Group, where he counsels banks, fintechs, custodians, exchanges, stablecoin issuers, and investors on regulatory compliance, enforcement defense, and litigation risk across digital finance. He recently co-authored Banking and Digital Assets: Key Takeaways from the President’s Working Group Report, analyzing how federal regulators are reshaping bank participation in digital asset custody, trading, tokenization, and other blockchain-based financial services.

Recognized by the Los Angeles Business Journal as a Leader of Influence, Phil has built a record of defending clients in high-stakes enforcement actions and complex litigation brought by the Securities and Exchange Commission (SEC), the Federal Trade Commission (FTC), the California Department of Financial Protection and Innovation (DFPI), and District Attorneys’ Offices across California. He has significant experience representing private credit funds in real estate and structured finance disputes, including distressed asset litigation, cross-border transactions, and bankruptcy proceedings.

Before practicing law, Phil served four years as a tank officer in the U.S. Army, achieving the rank of captain and earning the Bronze Star Medal during one of his two combat tours in Iraq. That experience forged his ability to lead under pressure, prepare with precision, and execute with speed. Clients value his strategic discipline and relentless drive to achieve results.

Representative Experience

Phil has served as lead litigation counsel for plaintiffs and defendants in financial-services, private-credit, and related commercial disputes and enforcement matters, including:

  • IIP-CA 2 LP, a subsidiary of publicly traded real estate investment trust Innovative Industrial Properties, Inc., in a construction-finance fraud bench trial that resulted in a $12.5 million award, including $4 million in punitive damages.
  • Medalist Partners, LP and affiliated asset-based private credit funds in coordinated litigation, receiverships, bankruptcy proceedings, and foreclosure actions to enforce secured-creditor rights following borrower defaults and alleged fraud affecting a multi-family property portfolio and California鈥檚 Project Homekey permanent supportive housing program.
  • RBC Royal Bank (Bahamas) Limited in federal banking litigation resulting in summary judgment and recovery of disputed funds in a case involving wire transfers, bank setoff rights, trust principles, and Articles 4A and 9 of the Uniform Commercial Code.
  • American National Insurance Company and its affiliates as secured lenders in SEC receivership proceedings arising from Gina Champion-Cain鈥檚 nearly $400 million Ponzi scheme, obtaining relief to enforce collateral rights, foreclose on commercial properties, and achieve full recovery.
  • EB-5 investment sponsor and regional center in an SEC investigation concerning $50 million raised to finance a residential golf course development, which concluded without enforcement action.
  • Principal of an international residential resort development in FTC enforcement litigation concerning more than $100 million in residential property sales and financing in Belize.
